In case of any inconsistency, the Warranty Policy and/or the warranty details specified in the invoice or order confirmation shall prevail.

Any illustrations, renderings, marketing materials, social media content, testimonials, or performance descriptions are provided for general reference purposes only and shall not constitute guarantees, warranties, or binding performance commitments unless expressly incorporated into a written agreement executed by Decibelus.

13. Acoustic Performance Disclaimer

The acoustic performance data presented on this Site, including but not limited to absorption coefficients, graphical representations, and Noise Reduction Coefficient (NRC) values, are indicative estimates derived from accepted industry data for materials and constructions of similar composition, density, and configuration.

These values are provided for general informational and illustrative purposes only and do not represent product-specific laboratory testing under ASTM C423 or any equivalent standard.

Actual acoustic performance may vary based on several factors, including but not limited to:
Installation method and mounting conditions
Room size, geometry, and surface materials
Placement and quantity of panels
Environmental and usage conditions

Accordingly, the data should not be interpreted as a guarantee of performance or outcome.

Nothing in this section limits or excludes any rights available to consumers under applicable law, including the Consumer Protection Act, 2019.

The suitability of any product for a specific application remains the responsibility of the customer or specifying professional.

21. Force Majeure

Decibelus shall not be liable for any delay, failure, or interruption in performance arising from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, labor disruptions, supply chain interruptions, material shortages, transportation delays, utility failures, cyber incidents, or failures of third-party service providers.

22. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India.

Any disputes shall be resolved by arbitration seated in Delhi, in accordance with the Arbitration and Conciliation Act, 1996. Arbitration shall constitute the exclusive mechanism for resolution of disputes arising out of or relating to these Terms, except for interim, injunctive, or equitable relief.

Courts in Delhi shall have exclusive jurisdiction for interim relief and enforcement.

The parties agree that the existence, conduct, and content of any arbitration proceedings, including all materials, submissions, and awards, shall remain confidential except where disclosure is required by applicable law or for enforcement of an arbitral award.

23. Policy Hierarchy

In the event of any conflict between these Terms and any specific policy (including but not limited to Shipping, Refund, or Warranty policies), the relevant specific policy shall prevail with respect to its subject matter.

24. General Provisions

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.

Failure to enforce any provision shall not constitute a waiver of rights.
